Terms and Conditions for Drivers - Along Transport Limited

Welcome to Along Transport Limited! These Terms and Conditions of Use ("Terms") govern your access and use of our mobile application, website, and services (collectively, "Services") as a driver. Along Transport Limited ("we," "us," or "our") provides these Services to you ("Driver," "you," or "your"), subject to the terms outlined below. By accessing and using our Services, you agree to comply with and be bound by these Terms. Please read them carefully.

1. Acceptance of Terms

By using the Along Transport app and Services as a driver, you agree to be bound by these Terms, our Privacy Policy, and any other applicable laws and regulations. If you do not agree with any part of these Terms, you must not use our Services.

2. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our discretion. If we make changes that materially affect your rights, we will notify you through our app or via email. Your continued use of our Services after such changes constitutes your acceptance of the new Terms.

3. Eligibility

The Services are not available to persons under the age of 18 or to any users previously suspended or removed from the Services by Along Transport. By using the Services, you represent that you are at least 18 years of age and have not been previously suspended or removed by Along Transport.

4. Account Registration and Use

4.1 Account Creation

You must register for an account to use our Services as a driver. During registration, you must provide accurate and complete information as requested. This includes providing your National Identification Number (NIN), Bank Verification Number (BVN), a valid driver’s license, vehicle registration details, and other necessary documentation. You are responsible for keeping this information up-to-date.

4.2 Account Responsibilities

You are responsible for all activities that occur under your account. You must keep your password secure and notify us immediately of any breach of security or unauthorised use of your account. You agree to use strong passwords and take reasonable measures to protect your account from unauthorised access.

4.3 One Account Per Driver

You may not create more than one personal account. If you operate multiple vehicles, each vehicle must be registered under a single account.

5. Service Use Restrictions

You agree not to engage in any of the following prohibited activities:

Copying, distributing, or disclosing any part of the Services in any medium.
Using any automated system, including robots, spiders, offline readers, etc., to access the Services.
Transmitting spam, chain letters, or other unsolicited emails.
Attempting to interfere with, compromise the system integrity or security, or decipher any transmissions to or from the servers running the Services.
Taking any action that imposes, or may impose at our sole discretion, an unreasonable or disproportionately large load on our infrastructure.
Uploading invalid data, viruses, worms, or other software agents through the Services.
Collecting or harvesting any personally identifiable information from the Services.
Using the Services for any commercial solicitation purposes.
Impersonating another person or otherwise misrepresenting your affiliation with a person or entity, conducting fraud, hiding, or attempting to hide your identity.
Interfering with the proper working of the Services.

6. Driver Obligations

6.1 Provision of Transport Services

You agree to provide transport services to passengers in a safe, professional, and reliable manner, in accordance with all applicable laws and regulations. You must follow all traffic laws, ensure the safety of your passengers, and treat all passengers with respect.

6.2 Vehicle Requirements

Your vehicle must meet all relevant safety and regulatory standards and be maintained in a clean and roadworthy condition. This includes regular maintenance checks, adherence to emission standards, and ensuring the vehicle is free from any mechanical issues that could pose a safety risk.

6.3 Conduct

You must conduct yourself professionally and courteously at all times. You are prohibited from engaging in any inappropriate, abusive, or unlawful behaviour. Any form of discrimination, harassment, or violence is strictly prohibited.

6.4 Compliance with Laws

You must comply with all local, state, and federal laws and regulations governing the provision of transportation services. This includes possessing and maintaining all required licenses, permits, and insurance coverage.

7. Payments and Fees

7.1 Fare Calculation

Fares are calculated based on a base fare, distance travelled, and time taken for the ride. Additional fees may apply for tolls, surcharges, and other expenses incurred during the ride.

7.2 Payment Processing

Payments from passengers are processed through the Along Transport app. You authorise Along Transport to collect fares and any applicable fees from passengers on your behalf and to deduct any applicable service fees before remitting the balance to you.

7.3 Service Fees

Along Transport charges a service fee for the use of our platform and services. This fee is a percentage of each fare and will be deducted from your earnings.

7.4 Payouts

Earnings will be remitted to your designated bank account on a weekly basis. You are responsible for ensuring that your bank account details are accurate and up-to-date.

8. Ratings and Reviews

Passengers can rate and review their ride experience. You agree to maintain a high standard of service to ensure positive ratings and reviews. Consistently low ratings may result in suspension or termination of your account.

9. Insurance

You are required to maintain appropriate insurance coverage for your vehicle and passengers as required by law. This includes liability insurance, personal injury protection, and any other coverage mandated by local regulations. You must provide proof of insurance upon request.

10. Data Privacy

10.1 Data Collection

We collect personal information you provide directly to us when you use our Services. This includes your name, contact information, National Identification Number (NIN), Bank Verification Number (BVN), vehicle details, location data, and transaction information. 10.2 Data Usage

Your personal information is used to provide, maintain, and improve our Services, process transactions, and communicate with you. We may share your information with third parties for service delivery, legal reasons, or with your explicit consent.

11. Intellectual Property Rights

The Services and all materials contained therein, including, without limitation, Along Transport logo, design, text, graphics, and other files, and the selection and arrangement thereof are the proprietary property of Along Transport or its licensors. You may not use such materials without permission.

12. Third-Party Links

The Services may contain links to third-party websites or resources. You acknowledge and agree that we are not responsible for the availability of such external sites or resources, and do not endorse and are not responsible or liable for any content, advertising, products, or other materials on or available from such sites or resources.

13. Termination

We may terminate or suspend your account and bar access to the Services immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

14. Indemnity

You agree to defend, indemnify, and hold harmless Along Transport, its officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses arising from: (i) your use of and access to the Services; (ii) your violation of any term of these Terms.

15. Limitation of Liability

In no event shall Along Transport, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Services; (ii) any conduct or content of any third party on the Services.

16. Governing Law

These Terms shall be governed and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to its conflict of law provisions.

17. Dispute Resolution

Any disputes arising out of or related to these Terms or the Services will be handled in the competent courts of Nigeria.
